Circa 74 Limited Warranty – Europe

This warranty only applies to the original purchaser who is a resident in a country of the European Union, Switzerland, or Norway. It covers Circa 74 amplifiers from defects in workmanship and materials under normal use for a period of 2 years from the date of purchase. Limitations and restrictions apply. Taylor-Listug Operating B.V., Maroastraat 113, 1060 LG Amsterdam, Netherlands ("TAYLOR GUITARS"), grants the following limited warranty ("Limited Warranty") for amplifiers of the brand "Circa 74", subject to the limitations set forth herein, in each case provided that (i) you are the original purchaser of the amplifier; (ii) you are resident in a country of the European Union, Switzerland, Norway; and (iii) you have purchased the amplifier from TAYLOR GUITARS or an authorized TAYLOR GUITARS dealer.

2-Year Limited Warranty.

TAYLOR GUITARS warrants solely to the original purchaser of this CIRCA 74 amplifier that the amplifier shall be free from defects in materials and workmanship under normal use for a period of two (2) years from the date of original purchase, provided that the product is used in accordance with published guidelines and instructions, such as the user manual. 

Warranty Repair.

If you make a valid claim under this Limited Warranty, TAYLOR GUITARS will, at its choice, either repair the defective product or replace its defective parts without charge to you for either parts or labor.  For such repair or replacement ("Warranty Repair"), TAYLOR GUITARS may utilize the materials and parts then in use rather than the original materials and parts used for production of the product. TAYLOR GUITARS may choose to have the Warranty Repair carried out on its behalf by an authorized TAYLOR GUITARS dealer, distributor or repair center.

Exclusions. 

This Limited Warranty does not apply:

(a) to wear and tear of the amplifier or other damage or deterioration due to normal wear and tear or breakage of any part of the amplifier;

(b) to asserted defects or damage that are part of normal usage or that are caused by modification, misuse, neglect, abuse, accidents, acts of nature, or improper maintenance or storage of the amplifier or its parts (TAYLOR GUITARS reserves the exclusive right to make such determination of misuse, modification, or neglect based on inspection by TAYLOR GUITARS);

(c) to asserted defects involving subjective personal likes or judgments, including subjective opinions regarding tonal characteristics of the amplifier or grain characteristics or colors of woods;

(d) to asserted defects or damage to an amplifier such as cracks, splitting, or warping of wood or damage to the amplifier’s finish caused by accident or exposure to changes in or extreme instances of temperature or humidity, exposure to sunlight, moisture, body salts or acids which cause harm to the amplifier;

(e) to defects asserted by any purchaser who did not purchase the amplifier from an authorized TAYLOR GUITARS dealer in the European Union, Switzerland, or Norway;

(f) to amplifiers owned by non-residents of the European Union, Switzerland, or Norway;

(g) to setups, adjustments, or any routine maintenance;

(h)  to any ancillary products that may be connected to the amplifier, including but not limited to, musical instruments, microphones, or other machinery or technology;

(i) to the power cable included with the amplifier, since it is not a material part or attachment.

(j) to any amplifier whose serial number is missing, altered, or tampered with in any fashion; or

(k) to asserted defects or damage to an amplifier which has had work performed on it by or has been otherwise repaired or modified by a technician or repair person other than a TAYLOR GUITARS certified technician at an authorized TAYLOR GUITARS service center.

Limitations.

THE OBLIGATIONS OF TAYLOR GUITARS HEREUNDER ARE LIMITED TO REPAIR OR REPLACEMENT OF PARTS OF THE AMPLIFIER FOUND TO BE DEFECTIVE UNDER THIS LIMITED WARRANTY. IN NO EVENT SHALL TAYLOR GUITARS BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO TIME, WAGES OR LOST PROFITS, OF ANY NATURE OR KIND OR FOR DAMAGES TO OR LOSS OF PROPERTY.

This Limited Warranty does not cover circumstances beyond TAYLOR GUITAR’s control nor does it apply when failure is due to shipping damage, accident, alteration, modification, unauthorized service, misuse, abuse, use with incompatible accessories or attachments. THIS LIMITED WARRANTY IS THE SOLE WARRANTY OF TAYLOR GUITARS WITH REGARD TO AMPLIFIERS ONLY AND IS GIVEN IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PURPOSE.

In addition, TAYLOR GUITARS reserves the right to modify, refine, or improve its products and parts, including making mechanical and electrical refinements and wood species substitutions, without incurring any responsibility to modify, exchange, replace or repair any parts or products to meet prior specifications.

Specific rights might vary by country, so the above limitations or exclusions may not apply to you.

No Other Warranties.

The Limited Warranty set forth herein constitutes the entire warranty and representation of TAYLOR GUITARS with regard to the Circa 74 amplifiers. This Limited Warranty shall be controlling over any conflicting terms and conditions of any purchase orders, contracts or invoices which may be executed in connection with the purchase of any TAYLOR GUITARS Circa 74 amplifier. No representation or warranty made by any TAYLOR GUITARS salesperson, dealer, agent, representative or employee shall be binding upon TAYLOR GUITARS other than as set forth herein.

Claim Procedures.

In order to make a claim under this Limited Warranty, you must first contact TAYLOR GUITARS (or, alternatively, any authorized dealer, distributor or repair center). A list of current authorized repair centers is available at https://www.taylorguitars.com/support/repair-centers. If you plan to ship your guitar instead of visiting a repair center in person, you must first call TAYLOR GUITARS for a return authorization number. In Europe, call +31 (0) 20 667 6033. After getting a return authorization, you must obtain and pay for any permits required to export from your country to The Netherlands; then you must send the product with any required permits, with shipping and insurance prepaid by you, to TAYLOR GUITARS at B.V., Maroastraat 113, 1060 LG Amsterdam, Netherlands, together with (a) evidence confirming the original purchase by you (such as a copy of the sales invoice or receipt, a credit card slip, or the like); (b) a brief description of the nature of the asserted defect and photographic or other documentary evidence requested by TAYLOR GUITARS; and (c) your name and phone number and your address to which the product is to be returned. If you fail to contact TAYLOR GUITARS prior to exporting your guitar from your country, or if you fail to get any necessary permit for your guitar, the guitar could be subject to government confiscation and/or TAYLOR GUITARS may not be able to obtain a permit to ship it back to you in your country.

If your claim is valid, the product will be returned to you upon completion of the Warranty Repair, with shipping, permits and insurance to be paid by you. In the event it is determined that an asserted defect is not covered by or is excluded from this Limited Warranty, you will be contacted with an estimate of repairs. If you do not give approval for the cost of the repair, then the product will be returned to you without repair or replacement; any costs for shipping, permits and insurance are to be paid by you.

TAYLOR does not make any other express warranty than stated herein or any implied warranty, in particular not regarding the fitness for a particular purpose or its merchantability. No representation or warranty made by any TAYLOR GUITARS salesperson, dealer, agent, representative or employee shall be binding upon TAYLOR GUITARS other than as set forth herein.

Non-transferability. 

This Limited Warranty is not transferable or assignable in whole or in part without TAYLOR GUITARS’ prior written consent.

Your statutory rights. 

Consumers subject to the EU Consumer Rights Directive, have legal rights under applicable national legislation governing the sale of consumer goods (including, without limitation, in the event that a product is defective or otherwise not in conformity with the contract for sale). This Limited Warranty does not affect your legal rights under such legislation, which exist independently of what this warranty covers and of whether or not you choose to claim under this warranty.
